The Intending applicant is to apply in Company’s Prescribed form for booking of a plot in Land Development Unit. with earnest money, availing the privileges for the payment of balance amount of total tentative price of plot/flat by prescribed easy installments of the company according to his/her capacity or applicant may at his/her option pay such balance amount of total tentative price of plot/Bunglow at a time, with due formalities for such booking of the plot/bunglow. The minimum earnest money of Rs. 25000 is fixed per plot/bunglow which is to be paid at the time of application for booking of the plot/bunglow with a condition to pay the balance of total tentative price of plot/bunglow by the applicant positively within 2 Yrs from the date of application for the execution of sale deed in his/her favour respectively.

The Earnest money for booking of the plot/bunlgow is fixed at Rs. 25000 per bunglow and tentative consideration value is also fixed on different rates and different plots/bunglow at present but subject to change / vary in price in respect of market value of such plot/bunglow time to time and the applicant shall be bound to pay such price on such situation at the time when the sale deed is executed in his/her favour.

The applicant shall have to pay the installments in time and upon his/her failure the company may charge permissible interest for delayed payment or rescind the contract.

The Intending applicant shall have to complete the payment in full in respect of his/her booking within the prescribed time limit positively, until and unless the time is extended by the company under special circumstances.

Upon receipt of completed application form along with earnest money from the intending applicant the company will accordingly issue an acknowledgement slip in favour of the applicant regarding the receipt of payment of earnest money and issue a “provisional allotment certificate” in favour of allotte(s) in respect of property

Upon receipt of full payment of the plot/bunglow, the company will issue “final allotment letter” in favour of the allotees within 7 days to satisfy the applicant mentioning details of the allotted property or if necessary to avoid any complication between the parties, a formal agreement for sale of plot/bunglow may be executed prior to the final allotment letter in favour of the allotees by RSV Dream Realty Private Limted or on demand of the applicants.

Upon receipt of full and final payment of consideration amount of property, the company will execute and transfer the property by virtue of a registered sale deed in favour of the applicants with 7 days and deliver possession thereof unto purchasers in addition to prompt allotted property, and in all cases, stamp duty, registration charges and incidental charges etc. shall be borne by the applicant himself/herself. The applicant shall pay rent and taxes etc. to the concerned authority in respect of the property as and when required time to time after such execution in her/her favour to the effect of mutation.

The applicant at his/her option however may cancel the booking and on such situations the applicants is/are entitled to get refund his/her earnest money from the company with due formalities as agreed between the parties for the purpose.

The expression “allotment” where used herein shall always mean “provisional” and will remain in force till final allotment.

Application in the prescribed form as contained in the brochure is subject to the general terms and conditions stated herein and shall be treated as a part and parcel of the formal agreement for sale of property required to be executed later on, if necessary.

Correspondence will be made with the applicants at the address given for correspondence on the application form of RSV Dreams and Realty Private Limited.

The applicants must quote the application number as printed in the acknowledgment pay-in-slip and on allotment, the allotment letter no. in all further correspondence.

The allotees shall sign and execute all the documents in the standard form etc, as may be provided by RSV Dreams Realty private limited as and when required.

The applicants after being satisfied shall have to comply all the terms and conditions of the company.

Disputes if any shall be referred to the Arbitrators and the decision of the Abitrator/Arbitrators shall be final and binding upon the parties hereto in accordance with the Provisions of Arbitration & Conciliation Act, 1996.

The Company reserves the right to reject any application without assigning any reason whatsoever.

All disputes are subject to the Jurisdiction of the courts in the District North 24 Parganas, West Bengal.

Dear Sir/madam:

I/we have gone through the brochure containing the details regarding properties to be offered by the company and I/we intend to purchase immovable property of RSV Dreams Realty Private Limited at -- Choose a Project -- The Solitaire — Nature's Beauty, Gopalganj, Bihar The Spectrum — Chowri Chowra, Gorakhpur, Uttar Pradesh The Elegance — Chakdah, West Bengal and undertake to pay the earnest money and balance amount by installment as per the terms and conditions of the company. I/We am/are Indian national (S).

DECLARATION

I/We hereby declare that I/We have applied for immovable property after going through the terms and conditions contained in the Company Brochure. Seen the site plan(s) and specification and do hereby undertake to complete the sale transaction when called upon to do so and abide by all the decisions of the company (RDRPL) in respect of the property to be allotted in my / our favour.

Further I/we hereby declare that all the information given by me/us are all true to the best of my/our knowledge and believe. In case the company detect or find any irregularities / discrepancies on my part, the company shall have the right to take action against me/us as per the law of the land.

Further, I/we have not suppressed any material information while giving my/our personal details to the company.

Further, I/we declare (that I/we must pay earnest money out of the plot/bunglow price as indicated and scheduled in the Company Brochure. The prescribed time of payment of installments shall always be the essence of contract. I//we also understand and accept that the physical infrastructure will be developed in due course of time.

Further I/we hereby undertake to pay the installments as per the company schedule in time for purchasing the property and upon failure on my/our part, the company may charge permissible interest for delayed payments or rescind the contract.

Further, I/we assume full responsibility for genuineness, validity and correctness of all signatures and endorsement appearing on the applications and the sources of fund.

Further, I/we agree to abide by all the terms and conditions and decisions of the company regarding allotment of property which will be final and binding upon me / us in all respects.
